American League rules:  batter swings ball hits off top hand goes foul.  Umpire calls dead ball batter out?

Correct if it was strike three.  I'm guessing it was.

It's a strike. If strike three then yes, that's the right call. Fact that went foul means nothing. 

You might be under the incorrect belief that "the hands are part of the bat", they are not.

Yes, if strike three.   Even if it goes fair.  Doesn't matter where the ball goes.  Ball is dead as soon as it hits the batter.
