Due to a chain of custody issue on his original specimen, Ryan Braun has been exonerated by a special MLB panel.

Evidently, the dude who was supposed to send out Braun's specimen to the lab on Friday, didn't send it until Monday, leaving open the opportunity to doctor it. Because Braun's specimen showed a testosterone level that was extremely high, and because of the chain of custody question, the positive result was thrown out.

Here is the MLB Joint Drug Prevention and Treatman Program which was good till 12/31/2011. PDF file.

You can read page 37 letter v under Section ten (roman numeral (X)) concerning where "Absent unusual circumstances, the

specimens should be sent by FedEx to the Laboratory on the ""same day they are collected"".

If you go to Section 11 (XI) you will find the word immediately under letter F. on page 38. Maybe the package was "immediately" prepared but then the Collector did not ship. It sounds like the only time you would put the samples in the fridge would be if you did not immediately prepare them for shipment. You would prepare them for shipment the next day like the beginning of section (XI) states rather than go ahead and prepare and then not ship.

"Braun said that he submitted a urine sample at 4:30 p.m., Oct. 1, after the Brewers 4-1 playoff victory in Game 1 of the National League Division Series against the Arizona Diamondbacks. The drug-testing collector, who administered the test, is required under the guidelines to immediately ship the test from a Federal Express to MLBs laboratory in Montreal. Yet, the official apparently thought that the FED Ex offices were closed until Monday. Braun said that his legal team discovered that five FED Ex offices were open until 9 p.m., including one that was open 24 hours. The test was not sent out until 1:30 p.m. Monday, Braun said, providing ample time for the sample to be tampered".

There were no "unusual circumstances" (holidays or whatever he was thinking), the Collector just did not "think" (why) any FedEx offices were open.

"""""MLB"""""" should have thought of (they got plenty of attorneys on staff who would know all about "chain of command" legal issues) and answered these types of questions long before this happened. They should have instructions for the Collectors with all the "open" FedEx locations in every MLB city or in any town where a sample would be taken. Any problem cities where no collections could be shipped after a late game or for any other reasons should be mentioned in the Drug Policy document above.

There was no excuse for him getting off on a technicality of this nature. That's why Bud is paid 18 million to have the people to make sure this does not happen. Even if the World Anti-Doping Organization says this would not have gotten him off with their organization, it did with this organization. There was no conscienable reason not to ship right after the sample, and then Braun would be in a position to have to prove that the drugs they found in his system were a medically necessary drug that everyone, including baseball, knew he was taking for medical purposes and he should not be penalized. As it was, he got off on a chain of command technicality that should not have happened with all the FED Ex places opened for shipment.

Here is the story from Biz of baseball at the bottom of the screen. His test scores were out of this world high as you can see from the article.

Because Braun’s case was overturned, not on the merits of some evidence that exonerated his high levels of synthetic testosterone in his system (his testosterone-to-epitestosterone ratio (T/E) showed 20:1 or 16 points over the threshold for a positive test), but due to a breach in the chain of custody protocol, baseball has been rocked on its heels.

Did? MLB find out about the score and tell the collector to leave the chain of command door open so he could escape. With a score this high, this blunder was about the only way Braun had to get out of this mess.

On the other hand, he gave the speciman at 4:30 on a Friday and they shipped at 1:30 Monday, so that was a possible 69 hours the sample was left unguarded, and would be plenty of time to mess with the speciman if there is someone out there who would know how to "fix or rig" the results without anyone finding out, if it is possible to tamper with the results and go virtually undetected. I am sure there was no police officer guarding over the package in the fridge 24/7 this whole time. If the collector left the package and left his house or left it in some other facility unguarded for even a second, you leave a way out for the offender.

Once again, MLB has an obligation to give all the collectors a complete list of all facilities for drop off and a list of all 24/7 FedEx places in every major city. We are not talking about specimens being taken in some remote area of the USA, the players all play in major cities. MLB and the collector conveniently dropped the ball on this one. Also, since when are all FedEx's that are 24/7 close on Saturdays and since when do FedEx's open so late i.e. 1:30pm on Monday's? He should have been there when the doors opened on Monday. Once again, such a blunder that you wonder if it was done on purpose. It probably wasn't, but who in there right mind is not going to take that sample right away, when many FedExes are open till 9 PM anyway? Did he have a hot date or what? There should never be something else the collector needs to do, after collecting the specimen. If there is no way to get the specimen to a FedEx after the collection, then just don't have the test at that time. Do all testing on get away day when the games end in the afternoon.

MLB should (and I bet they do) know exactly where every team stays on the road, where every umpire stays and how to get a hold of them immediately. They have more than the ability to provide all FedEx locations throughout the USA and to keep those locations updated at all times. It wouldn't cost crap to do this especially when you consider the Commish makes 18 million. For 18 million I expect to get a commish who can locate all FedExs throughout the country anytime, anywhere. I'm sure he can just call the CEO at anytime day or night and get this info. Who isn't going to take a call from the Commissioner of MLB? I even bet every President past and present would.

Look at how high that score was.

Although we know he was guilty, the new procedure should call for testing on Monday-Thursday only, so there is no time the sample sits anywhere and is shipped out the next day. There would be very few that could take the chance of doing something on Friday during the day or after the game and having it clear their system by Monday anyway. I don't think coke will help one play better like the steroids can and help build muscle bigger and faster to create that unfair advantage.

I'm sorry, I dwell in the real world, where I often focus on what is real and probable, and not what is stated as fact. They are often in conflict, such as with what Butt $elig represents.

And you just keep on being one of those believers of stated "facts." People like $elig need believers like you to operate the way they do. Enjoy your blissful state.
