Retag after crossing plate

assume OBR rules. Runner on 3rd, nobody out. Batter hits a ball in the gap. runner assumes it's going to fall in and trots home. After crossing the plate, he sees the fielder made a diving catch.  He sprints back to 3rd base, retouching the plate on the way back.  Is this legal?  Can the defense appeal he left 3rd early, after he goes back to 3rd base?

All legal.  The defense can appeal -- but the appeal will be denied.  The runner's actions are no different than "going halfway" and returning to the base after a vatche.

Retouching HP before returning to 3B is required. If he didn't retouch HP, a retouch appeal can be applied by the defense. 

The defense can appeal if they get the throw to 3B before the runner gets back there. Once he retouches 3B he has no longer left early as noumpere pointed out.

The French word for cow is spelled 'vache', without a 't', but I'm not sure what that has to do with it.
