batter clearly went on the pitch that hit him, but at the exact time he was hit he had not gone on the swing, so why did they not give him first. action after being hit does not count since the play is no longer live.

We would have to have a neurologist in NY to decide whether the contact with the hand caused the swing to continue or it was an offer and a dead ball strike.
