R1, Left handed batter R1 takes off for 2nd batter swings and misses for strike 3 and still in the box. catcher throws from 3/4 almost side arm and hits batter on top of helmet ball still goes out toward 2nd runner safe. I am PU and had nothing but DC wanted BI. I said no he was still in the box he did nothing wrong. Yes or no

As long as he did nothing more than swing he is fine. If he starts moving around or he moves out toward the plate then you may have something.

Batters can not instantly disappear.

Unless they do something to actually interfere with the throw, I have nothing.

Next time, instead of doing nothing, give a safe sign and say "That's nothing!" It shows that you saw the play, but ruled it wasn't BI.
