Throwing yo unoccupied base

Runner on 2nd. RH Pitcher comes set, checks the runner. Pitcher lifts his left foot straight up as is his normal motion. As he lifts his foot straight up the runner breaks for 3rd. Pitcher sees him and continues with one fluid motion and steps toward 3rd and throws to 3rd base which is not occupied. Balk or legal?

Legal.  It's a balk to throw to an unoccupied base EXCEPT FOR THE PURPOSE OF MAKING A PLAY.

 

That last part is often forgotten.
