Rule: all fielders other than F2 must be in fair ground at the TOP. For OBR, this means both feet in fair. OBR 4.03(c )

 

Enforcement: ignore until someone complains, then enforce equally for both teams. Instruct offender to move into fair ground before the pitch; if he fails to comply, eject. There is no other penalty. OBR 9.01(d)

That seems like poor fielding mechanics to me.  If F3 sets up in foul initially, he's taking himself out of position to field a batted ball, with no benefit of a tag on a pick-off before the pitch. 

 

I agree with the above answers, but I doubt the offense is going to complain much. ;)

in little league - can the first basemen set up in foul side of the line with both feet out to pick off a runner after the pitch.

I'm not sure he means "set up before the pitch". Trying to decipher the grammar, he might be saying can F3 move to the foul side of 1B after the pitch to receive a throw from F2 for an attempted pickoff. Which, of course is legal.

Per OBR all fielders except catcher must be fair. After that the fielders may move anywhere they wish for whatever reason.Case closed.

If you and me are talking about before the pitch It's a little more complicated than that. "when the ball is put in play" is part of the verbiage. MLBUM and PBUC allow F1 to not comply although the wording has recently changed enough to make me wonder what they want. MLBUM and PBUC also allow a fielder to go foul to back up an appeal throw. This is not something you should be concerned with unless somebody complains. Then apply Mavens remedy.

Unfortunately, if you are a new umpire whose only reference is the LL RIM, it will tell you to not allow this If we are talking about before the pitch.

Others have given the correct response if the OP was after the pitch. In all cases, other than FED and NCAA, there is no penalty.
