Assault Laws

I'm aware that some states have laws stipulating that an assault on an official is a felony. Does anyone know which states do and don't? Does NJ have one (not that I plan on needing it just wondering)?

In Alabama, it's a class "C" felony with up to $2000 fine and 20 years in prison

Only a misdemeanor but at least NC. is on the list. My question is this. Assault against anybody is at least a misdemeanor so what good is it to have a law specifying a sports official and it's only a misdemeanor. I'm no lawyer or police officer so I'm not sure what the difference is.

I don't take any abuse. I've only had 1 instance where I was actually threatened. He said he'd be waiting for me in the PL. Of course, he wasn't.

So it's there to make people understand that if you hit a sports official, that is a real person and it qualifies as an assault. WOW. That says a lot about how some people think.

Wow Alabama must be heaven compared to jersey. Ive lost count of how many times I've been told to be expecting visitors in the parking lot. And I've been told that I'd have my ass kicked about 5 times. And once (this is in the ejection forum) I had a pitch counter thrown at me. It says a lot about the respect in Alabama for officials because I'm sure you have been doing this longer than me trout. (4yrs)

It hasn't happened often to me but I have had threats to meet me in the parking lot and have even had a couple follow me to my truck. My favorite was a guy that claimed he was the law, turned out to be a prison guard. I kicked him off the property. Toward the end of the game the president asked if I wanted the police called. i asked why, he left as requested. He asked what would I do if he came back. I told him I would kick his ass. He said as long as I was comfortable with that, OK.

Typically when an existing law (assault or battery) makes an exception for a particular class (sports officials, the elderly, etc) it is to allow for an increase in the penalty. California for example lists the penalty for generic battery as a fine not to exceed $2000 and county jail time not to exceed six months. They increase the jail time to the maximum (one year) if the battery is against a sports official. All battery in California is a misdemeanor, unless certain injuries occur to the victim that would bump it up to a felony.

Personally, I have never had someone threaten me during a game. When I was a boot patrolman 30 years ago I handled a call at one of our parks during some type of Legion tournament. BOTH teams (and fans) wanted to kick BOTH of the umpire's ass for whatever reason. We arrived in the 5th inning and it was basically out of control. Neither umpire wanted anything done except to leave with all of their body parts (both were still on the field). We ended the game and escorted both to their cars. Funny though...the fans were the worst, but as soon as we ended the game, all they could wine about was the cops taking the game away from their kids.

We have few, in any, umpire assaults in my area. Soccer, however, is a different story. Seems like we have weekly calls to our adult indoor soccer arena where the ref is getting punched, pushed, etc.

Many times because it happens in the heat a sporting event it isn't an actual assault. Guess what, it is.

I was ddressing at my truck after a rec game getting ready to go home. Dude walks up friendly enough and starts talking. Turns out he's mad his kid Kd looking to end it. He starts getting agitated. As I was standing at my door already in civvies, I let him see me put my pistol on my pocket. He went away. Gotta love concealed carry laws!

I don't carry a firearm ( nothing political intended )but I do keep a little metal bat called Little Thumper in my passengers floorboard. Not as good as a gun, but in a pinch could inflict some serious damage.

I only meant that NJ is worse than Alabama with regards to insane people and the SH*# that umpires have to put up with especially at the lower levels. I said trout has encuntered less abuse than me and Im sure that he has umpired for longer than I have. I have been umpiring for four years.
